New Patent Writing

With the new patent underway, I thought it would be good to share some of the progress with the writing as well as some general things I use with my approach to drafting a document like this, because these can share some similarities with scientific writing but there are important differences also. The similarities lie in the literature review that makes up part of the Description section (view one of the earlier patents filed for more information and general section overview).

Like a scientific review, this part of the patent allows the examiners to look at the information and understand the current state of the field that the patent will apply to. In the case of the MOOVPAD PAPE framework, the goal is to outline specific parts of the science and recent advances so that the examiners understand that the patent being filed has considered the current state of the industry. I have been using the same kind of guidelines that I've always used for scientific writing. Normally, I try to be in the range of a source/reference per 50-75 words for the literature review part (so as to provide enough details without overwhelming readers). This part of the current patent is almost complete.

The rest of the patent involves detailing the new contributions of the 'invention' - in this case the scientific framework and extension - to the field/industry. This is the part that I'm learning to improve as I file these patents, because I am not a patent attorney by any means. However what I did initially was find as many examples of well written patents as I could from various industries, and then try to apply the key elements (like structure, language, detail breakdown strategies, etc) to my own work. And I think it's working so far.

But I also know I'm a lunatic in general, so... 🙂
